These Terms of Service (“Terms”) are a legally binding agreement between you and Givery, Inc. (“Givery,” “we,” “us,” or “our”). By accessing or using the Givery platform, including the website at givery.com and any associated mobile applications (collectively, the “Service”), you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, do not use the Service. We reserve the right to update these Terms at any time, and your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
Givery is a social gift-giving platform that allows users to:
Givery acts as a platform connecting gift-givers and wish-makers. We are not a retailer, marketplace, or financial institution. We facilitate the social coordination and payment processing of gifts but do not sell, ship, or guarantee any products.
You must be at least 13 years old (or the applicable minimum age in your jurisdiction) to create an account and use the Service. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you may only use the Service with the consent of a parent or legal guardian. By using Givery, you represent that you meet these eligibility requirements.
To use certain features of the Service, you must create an account. When registering, you agree to:
Each account is for a single individual. You may not create multiple accounts, and you may not create an account on behalf of another person without their explicit permission.
“User Content” means any content you create, upload, or share through the Service, including wish descriptions, images, thank-you messages, profile information, and any other material.
You retain ownership of your User Content. Givery does not claim ownership over any content you create or share on the platform.
By posting User Content on Givery, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, and distribute your User Content solely for the purpose of operating, promoting, and improving the Service. This license ends when you delete your content or your account, except where your content has been shared with or saved by other users.
You are solely responsible for your User Content. You represent and warrant that you have the right to share any content you post and that your content does not violate any third party's rights or any applicable law.

We reserve the right to investigate and take appropriate action against anyone who violates these prohibitions, including removing content, suspending or terminating accounts, and reporting conduct to law enforcement.
Givery enables users to contribute money toward another person's wish through our ChipIn feature. All payments are processed by Stripe. By making a contribution, you authorize Stripe to charge your payment method for the amount you specify.
Contributions made through ChipIn are voluntary gifts. They are not purchases, investments, loans, or donations to a charitable organization. When you chip in toward a wish, you are giving a gift to the wish-maker.
Contributions toward wishes that have been fulfilled (marked as granted) are generally non-refundable, as funds may have already been disbursed to the wish-maker. For unfulfilled wishes, refund requests may be considered on a case-by-case basis. Please contact us at support@givery.com for refund inquiries.
Givery may charge a platform fee on contributions. Any applicable fees will be clearly disclosed before you complete a transaction. Standard payment processing fees charged by Stripe also apply.
Wish-makers who receive contributions must connect a Stripe account to receive payouts. Givery is not responsible for delays or issues related to Stripe's payout process. You are responsible for any tax obligations arising from funds you receive through the Service.
We may set minimum and maximum contribution amounts for ChipIn transactions. These limits may change from time to time and will be displayed at the time of contribution.
The Givery name, logo, branding, visual design, and all related trademarks, service marks, and trade dress are the property of Givery, Inc. The Service and its original content (excluding User Content), features, and functionality are owned by Givery and are protected by copyright, trademark, and other intellectual property laws.
You may not use the Givery name, logo, or branding in any manner that suggests endorsement, affiliation, or sponsorship without our prior written consent.
The Service may contain links to third-party websites, products, or services (for example, links to products on external retail websites). Givery does not endorse, control, or assume responsibility for any third-party content, products, or services. Your interactions with third-party services are governed by their respective terms and policies.
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Without limiting the foregoing:
To the maximum extent permitted by applicable law, Givery, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of or inability to use the Service.
In no event shall Givery's total liability to you for all claims arising out of or related to the Service exceed the greater of (a) the amount you have paid to Givery in the 12 months preceding the claim, or (b) one hundred dollars ($100).
You agree to indemnify, defend, and hold harmless Givery, its officers, directors, employees, contractors, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of another party.
Before filing any formal legal action, you agree to first contact us at legal@givery.com and attempt to resolve the dispute informally for at least 30 days. Most disputes can be resolved this way.
If we cannot resolve a dispute informally, you and Givery agree to resolve any claims relating to these Terms or the Service through final and binding arbitration, except that either party may bring claims in small claims court if eligible. The arbitration will be conducted under the rules of the American Arbitration Association (AAA) and will take place in the State of Delaware.
You and Givery agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void.
You may terminate your account at any time by deleting it through your account settings or by contacting us. We may suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we determine violates these Terms, is harmful to other users, or is otherwise objectionable.
Upon termination, your right to use the Service immediately ceases. Sections that by their nature should survive termination (including but not limited to ownership, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.
If you have pending ChipIn contributions or unreceived payouts at the time of termination, we will make reasonable efforts to process those transactions. However, we are not liable for any losses resulting from account termination.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in Delaware.
We may revise these Terms from time to time. When we make material changes, we will notify you by posting the updated Terms on this page and updating the “Last Updated” date. For significant changes, we may also provide additional notice through email or a prominent notice on the Service. Your continued use of Givery after any changes constitutes your acceptance of the revised Terms.
